GENEVA (FAT) - The FIBA Arbitral Tribunal (FAT) has ruled on a dispute between the American player Khalid El-Amin and his agents as claimants and the Basketball Club “AZOVMASH” from the Ukraine as respondent.
The dispute arose over a player contract which according to the claimants was validly signed but which the respondent claims was not binding on them because they had retracted the contract offer. The player claimed the financial losses for breach of contract.
In a counterclaim the club claimed financial damage from a failed player contract with another player.
The FAT Arbitrator Mr. Quentin Byrne-Sutton declined jurisdiction over Azovmash's counterclaim and dismissed Mr. Khalid El-Amin’s, and his agents' claims . Ruling in equity – which he was authorized to do under the FAT Arbitration Rules – the arbitrator decided that the player's claim was unfounded in that he did not insist on the enforcement of the alleged contract with Azovmash but rather immediately moved on to a different club with essentially the same salary.
