    In view of the fact that AEP Olimpias Patras continues to be in breach of its obligation to honour the FAT award, FIBA imposed a ban on registration of new players on AEP Olimpias Patras.

    In accordance with Article L.2.7.1 of the FIBA Internal Regulations, FIBA sanctioned AEP Olimpias Patras with a monetary fine of EUR 15,000 for failing to honour the FAT award.

    Summary of the case:

    The Spanish player Alfonso Albert filed a claim against the Greek club AEP Olympias Patras BC for compensation for breach of contract. The player requested full payment of his salaries and amenities for the entire 2009/2010 season as well as an amount representing Spanish taxes.

    In its answer and counterclaim, the club denied the above claims submitting that the parties had signed only a preliminary agreement and that a final agreement would be signed if the Player would pass the medical tests, which he did not due to a pre-existing injury.

    The Arbitrator decided that the claim should be partially upheld and the counterclaim deemed withdrawn for failure to pay the advance on costs.
