    The American player Marc Salyers filed a claim against the Ukrainian club Azovmash Mariupol BC for compensation for breach of contract.

    The player requested full payment of his salaries for the 2008/09 season together with late payment penalties alleging that the club breached the contract by not paying his salaries.

    In its answer, the club denied the above claims submitting that the termination of the contract by the player was unjustified and thus the player was not entitled to claim payment of any outstanding salaries or penalties relating to the period posterior to the termination.

    Also, the club submitted that the contract did not foresee any penalty for late payments after the date of termination. The Arbitrator decided to partially uphold the claim.
