    Following FIBA’s intervention, the club Dynamo Moscow WBC honoured the FAT award and paid the adjudicated amounts to the claimants.

    Summary of the case:

    The Croatian player Anda Jelavic and the players’ agents Itzhak Nir and Boris Leltchiski filed a claim against the Russian club Dynamo Moscow WBC for outstanding salaries and agent fees.

    The player acknowledged that the club was entitled under the contract to early terminate the employment but requested payment of her salaries until 20 December 2008.

    In its answer, the Club disputed the jurisdiction of FAT contending that FAT was not mentioned in the player’s contract and that there was no written agreement between the club and the agents.

    During the proceedings before FAT the club paid part of the requested amounts to the player. The Arbitrator partially upheld the player’s claim and declined jurisdiction over the agents’ claims.
