Following FIBA's intervention, the club Besiktas honoured the BAT award and paid the adjudicated amounts to the claimant.

    Summary of the case:
The American player Kevin Fletcher and the agents Michael Hart, Ömer Kart and Elias Diamantopoulos filed a claim against the Turkish club Besiktas Jimnastik Kulübü for outstanding salaries, late payment penalties and agent fees. The Claimant requested full payment of his salary for the 2009-2010 season, submitting that the club had made partial payments only. In its answer, the Club accepted its obligation towards the player, arguing that its non-payment was due to the global financial crisis. However, the club submitted that the late payment penalties claimed by the player should be reduced and that it was not obliged to make any payments to the agents, as the relevant contract only mentioned two of the agents but did not specify any amounts payable to them. The Arbitrator decided to partially uphold the claim.
