Basketball Arbitral Tribunal publishes BAT COVID-19 Guidelines

MIES (Switzerland) – The Basketball Arbitral Tribunal, the independent body officially recognized by FIBA, which provides resolution services for disputes between players, agents, coaches and clubs through arbitration, has published a set of BAT COVID-19 Guidelines

Given the extraordinary situation caused by the current COVID-19 pandemic and in order to provide greater legal certainty to the basketball community, the Guidelines have been issued by the BAT President Prof. Dr. Ulrich Haas, the BAT Vice-President Raj Parker, and all BAT Arbitrators. They are intended to provide actual and potential BAT users with guidance in proceedings and help facilitate amicable settlements within the basketball community.

As an independent arbitration tribunal that has adjudicated more than 1500 basketball cases over the last decade, the BAT will decide in case of financial disputes arising from contracts which include a BAT clause. FIBA is not a party to these contracts or disputes and its role is limited to ensuring that the BAT awards, once issued, are honored by the parties.

FIBA wishes to encourage all players, coaches, agents and clubs to acknowledge the unique circumstances that we are all going through now and reach agreements with mutual concessions to the extent possible. It is important, especially in this period, to exhaust the possibility of an amicable settlement of a dispute prior to seeking recourse to the BAT or any other courts.
